An Assignment Contract is a written employment contract entered into between you and FYTE, your employer.The company where you will be working is the Client Company.
This contract is always drawn up in two original copies (one for you and one to return to us). Each contract, sent by post, must be signed upon receipt and returned to the personnel department by post.
You will have the same working conditions as the Client Company's permanent employees.
Maximum legal duration: 18 months
a) Absence or suspension of his/her employment contract (maximum legal duration: 18 months) b) Temporary change to part-time (maximum legal duration: 18 months) c) Permanent departure prior to the elimination of the position (maximum legal duration: 24 months) d) Awaiting the arrival of an employee recruited for a permanent position (maximum legal duration: 9 months)
Paid leave
At the end of the assignment we will pay you an amount in lieu of paid leave corresponding to 10% of your net remuneration (including end of assignment allowance). Consequently, any day off taken during your assignment and agreed by your line manager, will be a day of unpaid leave. You must send your holiday request, duly approved, to FYTE.

Compassionate leave
This leave may be taken, when justified and regardless of length of service, when certain family events arise during your assignment:
If the Client Company's CBA provides for longer periods of leave, you will benefit from this subject to meeting the conditions set out in the CBA.
Sick leave
You must inform us of absence due to illness within 48 hours. If you are absent for more than 3 days we will produce a certificate of salary and send it to your social security office who will pay you starting from the 4th day of absence. If you are absent for more than 4 days you can claim additional sickness benefit starting from the 5th day of absence, we will send the necessary documentation to AG2R La Mondiale.
Salary is paid via transfer the 11th of the month following the period worked.
You have the possibility to request an advance of 70% of hours worked each week by indicating 'YES' in the space provided on your validated time sheet (signature + company stamp). When requested, advance payments are made every Monday at 2:00 pm.

At the end of the contract, you will benefit from an end of mission allowance and a payment in lieu of holiday pay.
End of assignment allowance
To compensate for the uncertainty of your status as temporary worker, you will receive, at the end of your contract, an allowance corresponding to 10% of your total net remuneration paid during the assignment.However, it will not be due in the following cases:
Reimbursement of travelling expenses
If you use public transport to travel to the place of your assignment, transport expenses will be reimbursed on the basis of 50% of your travel card (weekly, monthly or annual), pro rata to the number of days worked during the assignment.
Reimbursement will be made upon presentation of proof of expenditure which you send via e-mail to: contrat@fyte.com.

Your contract can end at its stated termination date or earlier in the following cases:
During the trial period, without notice (the duration will depend on the dates of the assignment) :
During the flexibility period on the Client Company's initiative.
The flexibility period, as stated on your contract, is the time during which the Client Company can decide to shorten or lengthen the duration of your contract. It is calculated on the total duration of your contract, extendable by 1 day for each 5 days worked. Negative flexibility can never reduce the contract by more than 10 days.
If you have found a permanent position
You must send us your resignation letter by post together with a copy of your new employment contract or your offer letter in order to justify terminating your contract.You must observe a notice period of 1 day per week up to a maximum of 2 weeks.
If you are guilty of gross misconduct or there is a case of force majeure
These are the only two reasons which allow the Client Company to request early termination of your assignment.
In addition to the usual benefits of Social Security, a certain number of national agreements have been reached between the trade unions and employer organisations enabling you to benefit from complementary compensation in the case of illness or accident.
Social Security
Our temporary workers are insured under the general Social Security scheme. Consequently, you are entitled, like any other employee, to the benefits provided by the Caisse de Sécurité Sociale et des Allocations familiales.
Complementary pension
We subscribe to AG2R La Mondiale, a complementary pension fund. Every year, this fund sends us your total points earned for the previous year.
Illness or work accident
In addition to Social Security payments, in the case of sick leave (starting from the 5th day) or work accident (starting from the 1st day), subject to certain conditions, you may benefit from additional amounts paid by Intérimaires Prévoyance.

Maternity or adoption leave
An allowance in addition to that of the Social Security will be paid to you during your maternity leave providing you have worked at least 590 hours during the last 12 months or 1,400 hours during the last 24 months in the profession.
Hospitalisation
If you are hospitalised, following an illness or a work accident, you can benefit from a fixed amount to cover child care costs, providing you fulfill the conditions necessary to be covered by AG2R RÉUNICA Prévoyance.
Invalidity and death
In the case of category 2 or category 3 invalidity, a quarterly allowance will be paid to you, providing you have worked 1,800 hours in the profession during the 24 months prior to stopping work. In the case of decease during the assignment, but not linked to professional activity, death benefit will be paid to the beneficiaries without any conditions of time worked. Children will benefit from an education annuity when the deceased has worked at least 1,800 hours in the profession during the 24 months prior to decease. In the case of death due to a work accident or an industrial disease, the deceased's beneficiaries are entitled to death benefit or, where appropriate, an education annuity paid to the children if death occured during the assignment in the 12 months following the date of the accident. If death occurs following an accident during travel, death benefit will be paid to the beneficiaries. Children will benefit from an education annuity when the deceased has worked at least 1,800 hours in the profession in the 24 months prior to decease.
